Insurance Companies Are Only Concerned About Paying As Little As Possible

Monday, October 11th, 2010

Accident attorneys are also called personal injury attorneys. Most accident attorneys are well versed in more than one type of accident law. They are also able to offer their clients a general time line as to when the case is expected to be completed.

Accident attorneys are compassionate, experienced, and capable and they are dedicated in assisting accident and injury victims in all parts of the world.

Injuries can cause victims to lose income due to missed work because of the injuries sustained and the medical care required. People involved in car accidents become stressed due to the time involved in recovering from an auto accident, the family responsibilities, the ongoing medical care and fear of the future.

Injuries such as head trauma, brain injuries, spinal cord injuries, disfigurement, amputation, paralysis, broken bones, and permanently disability are just some of the injuries victims of motorcycle accidents may sustain. Because motorcycle accidents can quickly alter a persons life, many motorcycle accident victims feel despair, sorrow, and hopelessness. Injuries include surgeries, permanent injuries, wrongful death, quadriplegia, paralysis, broken bones, brain injuries and coma.

Insurance companies are only concerned about paying as little as possible to people hurt as a result of a car accident and are always seeking methods to limit car accident claims. It is necessary to hire a car accident attorney that is able to determine the extent of your injuries in order to figure the maximum compensation you are entitled to.

Insurance adjustors pressure injured victims to take the first settlement that is offered. Their first offer is usually the lowest amount you can recover for your broken bone injury. Insurance companies have a team of investigators, adjusters, agents and legal help to protect them. As the automobile accident victim, you need your own team of legal experts to protect you.

What You Should Know About Hiring Accident Lawyers

Sunday, July 25th, 2010

If you have been injured, surely you have many things going through your head at this time. Seeking out the advice of a lawyer may not be among these things. If this is the case, then you should change the direction of thinking. One of the biggest reasons has to do with how important to know the kinds of things that accident lawyers can help you with and here is the information that you need to know.

Any lawyer that you work with will have gone and gotten their bachelors degree and then went on to finish six or more years in school. Therefore, they are well trained within the area that you need them. They will know how to represent you and speak for you and that way you do not have to worry about being taken advantage of. When you are going to sue someone, you will need the backing of someone who knows the law well and a lawyer is exactly that person.

Many times, people tend to forget how the people they know are one of the best resources to refer to. Generally, your neighbors, friends, and family are going to try to refer you to accident lawyers that are reputable. In many cases, this can save you time from doing your own search. Generally, you should only ask those that you can trust.

Unfortunately, this is something that will not always work. If this is the case, then you could try using the phonebook. When you use the phonebook, you will find the different options listed under attorney or lawyer. After you find some within the area, then you should call them and find out additional information. Often, this can take a lot of time and is not one of the top choices for people.

However, online is another option if this type of situation arises. In general, you will find this is one of the fastest ways since there are sites, which focus solely on helping people with finding a lawyer. Usually, most people do not have time to write down and call the different lawyers they find and is the reason that this usually is the better option.

One of the other advantages of searching online involves how you can look up reviews on the lawyer that you are thinking about using. With the phonebook, you do not have the option of finding what other people think of them or the kind of experiences that people had with them. Often, this is essential for someone in order to find the best lawyer.

With that said, always write down your top choices throughout the time you are searching. Afterward, you should perform inquiries regarding those that you are interested. This way, you can find out, which is rated over the other.

You should always look for accident lawyers that has won a high amount of cases opposed to losses. Ultimately, you could find someone who has been in practice for a long time but has done poorly regarding the number of cases they have won. This is the reason why it is so important that you do research on the lawyer that you are thinking about using. This way you lower the chances of running into problems in the future.

Choosing A Disability Attorney

Friday, October 2nd, 2009

You have seen all the statistics. When you have a case, you are more likely to receive compensation and be approved for your disability claim if you work with a lawyer than if you had done it alone. Disability attorneys have a higher chance at success, which is why as a claimant you should consider hiring a disability attorney. You know you need one, but the question remains: How do you choose the best disability attorney for your needs?

There are a lot of dodgy lawyers out there that prey on people in time of distress. It’s why lawyers often are burdened with a bad reputation. But even though there are many law firms and disability attorneys looking for just money, there are also lots of them that actually want to help you win your disability claim and get you the money you deserve.

If you are choosing a disability attorney, you’ll want to choose one that will help you present a winning case that is in line with each regulation and rule from the Social Security Administration. Often, this is easier said than done.

Once the claim is set forth, disability attorneys will next gather all the evidence they need to support you. This step also includes contacting experts who will ultimately support your claim during a testimony. Disability attorneys talk with your doctor, so that your physician understands everything the administrators are looking for. With all of these witnesses, your attorney creates a report. This report will work with your specific case and the administration for Social Security.

Sometimes, after all of this work, your claim might still be denied a second time. If this happens, then disability attorneys will take the next step, which is representation. Either this will be a hearing with a judge, or an ALI hearing, which is different because it is not as formal. For a hearing with a judge, few people will be present, including the judge, their assistant, experts from your disability attorney, yourself and your attorney.

The disability attorney will be the one asking you questions during the hearing. Before the hearing has started, your lawyer will have briefed you on the questions, so you will know what to expect.

When you are looking at disability attorneys, look for one who is willing to work with you every step of the way. A good attorney will keep you informed of everything you need to do, and they will update you of anything that comes up. Through these updates, you will have a good idea of what will happen with your case. A good disability attorney will be able to add up all the calculations to determine if the benefits you receive are fair and right.

If you need help with your disability case, make sure to look at all the disability attorneys out there. Make sure to find one who is willing to work for you, with you, and is determined to win your case, not just determined to make a buck.

Can You Settle Your Own Personal Injury Case Without A Lawyer?

Friday, August 21st, 2009

Most of the time, the answer is yes, but it depends on the type of case you have. If your case is small, meaning relatively low dollar value, then you can probably get by on your own without having to use a lawyer. However, knowing whether you have a small or big dollar case may be an issue you want to discuss with a lawyer.

Referring to a small case is not meant to diminish the importance because all cases are important to the people injured. However, our legal system cannot restore your health. All it can do is require the party at fault to pay you some money in return for your damages. So small means what you should be able to realistically expect to receive in payment for your injuries.

Some criteria to determine if your case might be considered a small case include the following: (1) your vehicle was only lightly damaged, like a bumper scratch/dent, (2) the medical treatment was for a soft tissue injury and lasted only 2-3 months, (3) the bills were not more than $3,000 to $5,000, and (4) the injuries were not permanent.

Typical cases that might qualify as small cases are rear-end collisions where there is only minor damage to the vehicle; where the injured person only saw a chiropractor and was diagnosed as having a soft tissue injury and recovered fairly quickly with no long-term permanent effects. These are the type of cases that people often settle for themselves.

If you have a small case, you still need to make sure your medical treatment is finished before trying to settle your claim. Ofteny doctors, such as chiropractors, will tell you that you have reached maximum medical improvement, or MMI. At this point, they will release you from treatment and tell you to come back if you have any problems. Once you are released, you will want to collect the bills and records from all medical providers who have treated you for your injury. If you were initially transported by ambulance and were treated in the ER of the hospital, you will want to collect these records as well.

After you have collected your medical records, you should write a letter to the insurance company stating your your demand or request for settlement. In your letter, you should ask to be reimbursed for your medical bills (and future medical bills if applicable) as well as the pain and suffering you went through and/or expect to go through in the future. You can present your own offer or ask them to make you an offer. The insurance company will then contact you and give you their offer. In most cases, their offer will be less than what you were hoping for. You are always free to make a counter offer and to negotiate with them.

The insurance company could offer to settle your case for the cost of medical bills plus $500 to $1,000 for your pain and suffering. They might offer you more or less. But this is probably in the range of what you might see if you negotiate with them directly for this kind of small case. If you are negotiating a larger case, you should expect more than this. Some law firms offer a free service where they will review the offer from the insurance company, compare it against your records, and let you know whether the insurance company is making a fair offer or not.

Even when attorneys charge there their typical 1/3 contingency fee, it is usually better to use one in larger cases. A study that was done in 1999 by the Insurance Research Counsel, found that people who used a lawyer for their personal injury claim received on average 3 1/2 times more compensation than those persons who settled their own cases.

If your case is a larger case, you should ask the attorney whether they will insure that you receive at least as much as offered by the insurance company. Our practice is to insure our clients get at least as much as offered by the insurance company or we will cut our fee to make that happen. This means the client will end up with more money in their pocket than if they had done it alone. This is a good thing to ask the attorney you are thinking of using.
